2007 – Publication Sud-Soudan “Evaluation de l’accès égal à la justice et de la lutte contre l’impunité au Sud Soudan”

Publication 2007 Sud_SoudanEn 2005, suite à une demande du gouvernement belge, RCN Justice & Démocratie et Avocats Sans Frontières ont réalisé une étude relative à l’accès à la justice au Sud Soudan intitulée « Evaluation de l’accès égal à la justice et de la lutte contre l’impunité au Sud-Soudan ». L’analyse a porté sur le contexte politique, social, économique et surtout juridique dans le but d’examiner l’opportunité de développer un projet sur le renforcement de l’Etat de droit et d’identifier les principaux besoins en matière de justice. Cette étude a été finalisée au cours du premier semestre 2007.

Résumé de l’étude : The present study aims to contribute to establishing to contribute to establishing a secure foundation for the judicial system through an analysis of the functioning of the courts and the legal aid system two years after the signing of the CPA. The goal of the project is not to monitor the human rights situation in South Sudan, but to observe and map the current functioning of the judicial system, to understand the role of every stakeholder in the judicial process, to identify the main challenges faced by all stakeholders and the possible barriers restricting access to justice for the population, and to formulate recommendations for the rule of law institutions which could be useful to further the implementation of an effective and accessible justice system.

After a brief description of the project in the general context of Sudan (Part I), a closer look will be taken at every stakeholder of the judicial system of Southern Sudan (Part II). The current functioning of every institution is compared to that which is provided for by the legal Framework.
